What does the vacancy law mean for you?

If you get a license to rent out your property through the vacancy law, there are many advantages attached to this. Firstly, you can rent out your property without taking the points system into account. This means that you can set the rent yourself. Secondly, you can terminate without reason with a legal three-month notice period. Without the use of the vacancy law, you are obliged to let your property based on the point system and you can only get your property back before the end of the contract in case of urgent own use.

What are the costs associated with the vacancy law?

What conditions must you meet?

You will only receive a permit to let via the vacancy law if you actually meet all the requirements. The most important thing is that your property is for sale. It does not matter for the license whether you actually work with an estate agent. You must be able to provide a proof of sale order. Next, it is also important that you are no longer registered at the address of the property you want to let through the vacancy law. The property must be empty and therefore no one must be registered on it. However, it is possible to apply for the vacancy law permit while you are still in your property, but a move-in date must be given.

How long can you use the vacancy law?

If you get a permit, you can use it for 5 years. As such, the property must also be for sale for these 5 years. After these 5 years, you can no longer apply for the permit. However, it is possible to apply for the permit for another property. A maximum of two permits will be given per person (for two different properties).

Lease based on the vacancy law

If everything goes as desired and you have been able to let your property via the vacancy law, it is still important to make sure that everything goes according to the rules. For example, a temporary lease based on the vacancy law must comply with the following rules:

  • A temporary lease can be entered into for a minimum period of six months.
  • The notice period for the temporary tenant is at least one month.
  • The notice period for the landlord is at least three months.
